Terms of Service

These Terms govern your use of SunCoach. By creating an account or using the app, you agree to them. Please read them carefully — they include important information about subscriptions, the coach-client model, and the limits of what SunCoach can do (we're a tracking tool, not a medical service).

1. About SunCoach

SunCoach is a mobile and web application that helps users track nutrition, log meals using AI-assisted recognition, and optionally receive guidance from independent nutrition coaches. SunCoach is operated by:

In these Terms, "we", "us", "our", or "SunCoach" refers to the operator above. "You" refers to the person using the service.

2. Who can use SunCoach

You must:

• be at least 16 years old;
• provide accurate registration information and keep it up to date;
• comply with applicable laws in your country of residence.

If you sign up on behalf of an organization, you confirm you have the authority to bind that organization to these Terms.

3. Your account

You are responsible for keeping your account credentials safe. You agree not to share your account with others. If you suspect unauthorized access, contact us immediately at support@suncoach.app.

You may delete your account at any time — see Delete your account.

4. Subscriptions, billing, and refunds

SunCoach offers a free tier and paid subscription tiers. Paid subscriptions for clients and coaches differ in price; coaches have access to additional features for managing clients.

• Payments are processed by the Apple App Store (iOS) or Google Play Store (Android) via our subscription provider RevenueCat. We do not process card or bank details directly.
• Subscriptions auto-renew at the end of each billing period unless you cancel at least 24 hours before renewal. You can cancel anytime in your App Store or Play Store account.
• Refund requests are handled by Apple or Google according to their policies. We can support your request but cannot directly issue refunds for app-store purchases.
• Prices may change. If we change the price of a subscription, we will notify you in advance and you can cancel before the change takes effect.

5. Coaches and clients

SunCoach lets clients link to a coach. The following terms apply to that relationship:

• Coaches are independent users, not our employees or agents. We provide the technical platform; the coach-client relationship, including any service fees or programs, is strictly between coach and client.
• When a client links to a coach, the client explicitly consents to share their profile, goals, meal logs (including photos and voice notes), and progress data with that coach. The client can unlink at any time.
• Coaches agree to use client data only to provide nutrition guidance and to keep it confidential. Coaches must not export, share, or use client data for any other purpose.
• We are not responsible for the quality, accuracy, or outcomes of any coaching provided by an independent coach using SunCoach.

6. Acceptable use

You agree not to:

• use SunCoach for any unlawful purpose or to harass other users;
• reverse-engineer, decompile, or attempt to extract our source code or models;
• upload content that infringes copyright, contains malware, or violates another person's rights;
• attempt to circumvent rate limits, abuse the AI features, or interfere with the security of the service;
• impersonate another person, including impersonating a certified nutrition coach if you are not one.

We may suspend or terminate accounts that violate these rules.

7. AI features and accuracy

SunCoach uses Google's Gemini AI to estimate nutritional content from meal photos, voice notes, or text. AI estimates are approximations, not laboratory measurements. They may be wrong — especially for home-cooked meals, mixed dishes, or unusual ingredients. You should not rely on SunCoach's estimates for medical decisions or precise dietary requirements.

8. Not medical advice

SunCoach is a nutrition tracking and lifestyle tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. The information and suggestions in the app — including those provided by independent coaches — are for general informational purposes only.

Always consult a qualified healthcare professional before making significant changes to your diet, especially if you have a medical condition, are pregnant, are breastfeeding, are recovering from an eating disorder, or are taking medication. In an emergency, contact local emergency services.

9. Intellectual property

SunCoach, its logo, design, and software are owned by us and protected by copyright and other intellectual property laws. You retain ownership of content you upload (e.g. meal photos, voice notes). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to host, process, and display it to you and (if linked) to your coach — strictly to provide the service.

10. Service availability and changes

We aim to keep SunCoach available 24/7 but we don't guarantee uninterrupted access. We may release updates, change features, or discontinue parts of the service. If we discontinue a paid feature, we will provide reasonable notice and, where appropriate, a refund or credit.

11. Limitation of liability

To the maximum extent permitted by Swiss law:

• SunCoach is provided "as is", without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.
• We are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the service.
• Our total liability for any claim related to the service is limited to the amount you have paid us in subscription fees in the 12 months before the claim.
• Nothing in these Terms limits liability for gross negligence, intentional misconduct, or any other liability that cannot be limited under applicable Swiss law.

12. Termination

You can stop using SunCoach at any time by deleting your account. We may suspend or terminate your access if you breach these Terms or use the service in a way that harms us or other users. Sections that by their nature should survive termination (e.g. limitation of liability, intellectual property) will continue to apply.

13. Changes to these Terms

We may update these Terms occasionally. When we make material changes, we'll notify you via the app or email at least 14 days before the changes take effect. Continued use of SunCoach after that period means you accept the updated Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of Switzerland, excluding conflict-of-law rules. Where you are a consumer resident in another country, mandatory protections of your local law still apply.

Any dispute arising from these Terms shall be resolved by the competent courts of Winterthur, Switzerland, unless mandatory consumer-protection law requires otherwise.
